This comes after the New York State Education Department (NYSED) issued a guide that allows transgender and gender-expansive students to hide their gender identity from their parents, which has generated criticism from guardians and conservative groups.
According to the guidance, some transgender and gender-expansive students do not disclose their gender identity to their families due to safety concerns or a lack of acceptance. They may begin their transition at school without informing their parents or guardians. NYSED states that this guidance provides a framework and legal update for complying with state and federal laws related to harassment, discrimination, and student privacy.
The guidance supports students’ social transition by allowing them to live in accordance with their gender identity, including the use of a new name and pronouns. Some students may also express a willingness to receive medical treatment to reinforce their transition.
Authorities argue that only the student can decide whether it is safe to share their gender identity with their caregivers, and schools should be aware that some transgender and gender-expansive students are unwilling or unable to inform their parents of their situation. It is asserted that, due to family rejection, these youth face higher rates of homelessness and household instability.
However, this guidance has generated strong controversy among parents and in the political arena. Conservative groups and Christian legal advocates, such as Alliance Defending Freedom, have expressed their discontent, arguing that parents have a right to know what is happening to their children.
